The expansion of extractive corporations’ overseas business operations has led to serious concerns regarding human rights–related impacts. As theseapprehensions grow, we see a countervailing rise in calls for government intervention and in levels of socially conscious shareholder advocacy. I focus on the latter as manifested in recent use of the shareholder proposal mechanism found in corporate law. Shareholder proposals, while under-theorized, provide a valuable lens through which to consider the argument that economic behaviour is embedded within social relations. In doing (...) so, I situate my analysis within Third World Approaches to International Law (TWAIL) scholarship. Elsewhere, I have supported the use of corporate law tools in advancing the international human rights enterprise and argued that investment activism can be an essential component of this advancement. This paper represents a reflexive pause. Using the case study of a recent proposal submitted to Goldcorp Inc., I seek to problematize the shareholder proposal as a human rights advocacy tool and to examine it as a site of contestation. "Republicanism" in Kant's political philosophy describes the type of state and the kind of politics demanded by freedom. Thus understood, republicanism expresses the limits of practical reason in politics. ;Kant sets his political thought against Hobbes' empirical description of political individuals, for whom norms arise through imaginative "picturing" of various conditions. For Kant free practical subjects are motivationally independent of sensed objects and possess ability for self-legislation . Kant further maintains that ideas are "regulative", not constitutive, of human understanding, such (...) that correct use of them requires knowledge of their "principles." ;Because autonomy governs internal determinations, it cannot be the principle of republicanism, which as a matter of "right" concerns actions in their external aspect alone. Actions are subject only to moral possibility, or "permission". Kant's "permissive law" can be understood as law only if moral obligation is distinguished from the specification of duty, a distinction drawn by Achenwall, who influenced Kant. Right built on "permission" connects "first taking" and "intelligible possession". This explains two notions permeating Kant's political writings: obedience to state authority as such, and skepticism regarding any identification of existing arrangements with the idea of a perfectly rightful state. ;Thus conceived, right legitimizes various constitutions. The republican idea and its principle of "representation" are civil elaborations of permission's skeptical aspect. State authority represents the "universal united will", and cannot legitimately be resisted. ;This interpretation faces two challenges. One is unreserved cosmopolitanism, the claim that no right is conclusive without global authority. However, this position misinterprets "permission" as a preliminary violation of right, and therefore not as law. Secondly, the state may be seen as "rightfully" constituted for "fairness". This mistakenly attributes to Kant a Hobbesian view of individuals, and employs ideas not according to their principles , but in a direct, "pictorial" manner . ;Kant's "republicanism" is not an institutional arrangement but a principle of governance. The republican idea is the condition of the possibility of gradual, nonrevolutionary progress. Kant's "permission"---through its lack of specification and its deference to existing authority---is the expression of freedom in external contexts and the foundation of properly critical politics. A study was done with incoming freshmen, sophomore, senior, and graduate business students (n = 185) to assess the effects of moral development, gender, education level, and context on the moral choices in a simulated business situation, a potential hostile takeover of a fictional company. The results indicated that level of moral development did affect the decisions of students; however, main effects for gender, the level of education, and context were not significant. Theresults did find significant interaction effects between context (...) and moral development and gender and moral development. Students with lower levels of moral development were less likely to consider the contextual situation when making their decisions. The effect of moral development was more pronounced for female business students than for male business students. The implications of these results for ethics education in business schools are discussed. (shrink)

Traditionally, theories of concepts in psychology assume that concepts are a single, uniform kind of mental representation. But no single kind of representation can explain all of the empirical data for which concepts are responsible. I argue that the assumption that concepts are uniformly the same kind of mental structure is responsible for these theories’ shortcomings, and outline a pluralist theory of concepts that rejects this assumption. On pluralism, concepts should be thought of as being constituted by multiple representational kinds, (...) with the particular kind of concept used on an occasion being determined by the context. I argue that endorsing pluralism does not lead to eliminativism about concepts as an object of scientific interest. (shrink)

Curiosity and creativity are expressions of the trade-off between leveraging that with which we are familiar or seeking out novelty. Through the computational lens of reinforcement learning, we describe how formulating the value of information seeking and generation via their complementary effects on planning horizons formally captures a range of solutions to striking this balance.

This article argues, from a critical realist perspective, that it would be beneficial to extend thinking on how personal and social education could become more central to students’ learning. We explore how constructive-informed arrangements which emphasize cognitive skills and affective qualities could be realized through experiential approaches to learning. Our theorizing is informed by neo-Aristotelian thinking on the importance of identifying mutually acceptable value commitments which can cultivate practical wisdom as well as generally benefit society. Thereafter, we outline how the (...) recent writings of Tiberius could inform thinking on how, epistemologically and ethically, a first person perspective on learning and personal growth could connect with normative decision making on how to make good life choices. We conclude by briefly highlighting the methodological potential of using outdoor learning environments to help students make informed and wise judgements which show evidence of discernment, deliberation and effective decision making. William Osler's description of the ideal physician remains the dominant character-ideal for modern physicians. He believed that the personality traits that resulted from a belief in ascetic Protestantism, what has been called the Puritan temper, were essential in the practice of medicine. However, this idealism has been weakened by modern psychological theories which view idealism as an illness. In a culture oriented to health, rather than virtue, as an ultimate ideal, physicians can help develop a science of limits.

Research on economization processes is increasingly taking seriously the social and material processes through which various policy domains are transformed into economic problems and solutions. This article engages “Value Added Modeling” (VAM) in teacher evaluation systems as a case study in economization. VAM is a statistical technology for evaluating the effectiveness of schoolteachers using student test scores, which wrests authority for the determination of quality teaching away from education professionals and toward quantitative economic modelers. Mobilizing field theory, we trace a (...) half century of changing relationships among economists, other academics, and various policy audiences (from media to philanthropists to state and federal government) in struggles to define education policy concerning teacher quality. We show that economization is a set of overlapping, sometimes contradictory processes that can take different forms: in this case, the spread of an “economic style of reasoning” or the establishment of “economic policy devices.” The case of VAM shows stages of economization in which processes first proceeded independently of one another, then interacted in contradictory ways, and finally, mutually reinforced one another. What primarily drove these interactions was the struggle for scientific capital within the economics discipline and the changing place of education policy and VAM within it. Ultimately, VAM’s original role as a policy device for evaluating and selecting individual teachers has foundered even as it has become an important tool for economists to accrue scientific capital and expand their style of reasoning to broader audiences. Epistemic justifications for democracy have been offered in terms of two different aspects of decision-making: voting and deliberation, or ‘votes’ and ‘talk.’ The Condorcet Jury Theorem is appealed to as a justification in terms votes, and the Hong-Page “Diversity Trumps Ability” result is appealed to as a justification in terms of deliberation. Both of these, however, are most plausibly construed as models of direct democracy, with full and direct participation across the population. In this paper, we explore how these results (...) hold up if we vary the model so as to reflect the more familiar democratic structure of a representative hierarchy. We first recount extant analytic work that shows that representation inevitably weakens the voting results of the Condorcet Jury Theorem, but we question the ability of that result to shine light on real representative systems. We then show that, when we move from votes to talk, as modeled in Hong-Page, representation holds its own and even has a slight edge. (shrink)

The Temporal Satisfaction with Life Scale measures judgements of life satisfaction using 15 items, according to three temporal dimensions: past, present, and future. However, only seven studies have looked at the psychometric properties of the Temporal Satisfaction with Life Scale, and this has been individually across vastly different countries and cultures, and with different populations, such as undergraduate students, adults, and older adults. In addition, these studies have highlighted issues regarding the replicability of the validity of the scale structure and (...) optimal number of items. In this study we use a large international and multicultural sample from the International Wellbeing Study and investigate the scale structure of the Temporal Satisfaction with Life Scale, resulting in the recommendation that a shortened 12-item version provides a better model fit compared to the original 15-item version. More in-depth correlates with aspects of wellbeing and illbeing, in relation to past, present, and future life satisfaction, are also presented than have been previously, which found positive correlations between the temporal dimensions of the Temporal Satisfaction with Life Scale and wellbeing, as well as negative correlations with illbeing measures. G. Genzten’s 1938 proof of the consistency of pure arithmetic was hailed as a success for finitism and constructivism, but his proof requires induction along ordinal notations in Cantor normal form up to the first epsilon number, ε0. This left the task of giving a finitisically acceptable proof of the well-ordering of those ordinal notations, without which Gentzen’s proof could hardly be seen as a success for finitism. In his seminal book Proof Theory G. Takeuti provides such a proof. After (...) a brief philosophical introduction, we provide a reconstruction of Takeuti’s proof including corrections, comments, re-organization and notational adjustments for the sake of clarity. The result is a much longer, but much more tractable proof of the well-ordering of ordinal notations in Cantor normal form less than ε0, that nevertheless follows Takeuti’s strategy closely. We end with some more general comments about that proof strategy and the notion of accessibility more generally. (shrink)

Human motor learning is governed by a suite of interacting mechanisms each one of which modifies behavior in distinct ways and rely on different neural circuits. In recent years, much attention has been given to one type of motor learning, called motor adaptation. Here, the field has generally focused on the interactions of three mechanisms: sensory prediction error SPE-driven, explicit, and reinforcement learning. Studies of these mechanisms have largely treated them as modular, aiming to model how the outputs of each (...) are combined in the production of overt behavior. However, when examined closely the results of some studies also suggest the existence of additional interactions between the sub-components of each learning mechanism. In this perspective, we propose that these sub-component interactions represent a critical means through which different motor learning mechanisms are combined to produce movement; understanding such interactions is critical to advancing our knowledge of how humans learn new behaviors. We review current literature studying interactions between SPE-driven, explicit, and reinforcement mechanisms of motor learning. We then present evidence of sub-component interactions between SPE-driven and reinforcement learning as well as between SPE-driven and explicit learning from studies of people with cerebellar degeneration. Finally, we discuss the implications of interactions between learning mechanism sub-components for future research in human motor learning. (shrink)

In recent times, there has become a significantly greater emphasis on romantic ignorance. Romantic abundance facilitates finding a romantic (and sexual) partner, but is an obstacle for initiating and maintaining enduring, profound romantic relationships. The abundance of romantic information does not make adequate knowledge easy to obtain, and conversely has created a far more complex minefield to navigate. You will learn the disease is caused by the spirochete Borrelia burgdorferi, which is transmitted to people by blacklegged ticks . By carefully considering Galileo’s letters to Castelli and Christina, we argue that his position regarding the relationship between Scripture and science is not only of historical importance, but continues to stand as a perspective worth taking seriously in the context of contemporary philosophical debates. In particular, we contend that there are at least five areas of contemporary concern where Galileo’s arguments are especially relevant: (1) the supposed conflict between science and religion, (2) the status and stakes of evidence, (3) the (...) question of biblical infallibility in light of scientific progress, (4) metaphorical approaches to biblical hermeneutics, and (5) possible dialogical constraints on public discourse. In this discussion piece we address how the UK government has attempted to manage public expectations of a proposed biometric identity scheme by focussing attention on the handheld, i.e., the ID card. We suggest that this strategy of expectations management seeks to downplay the complexity and uncertainty surrounding this high-technological initiative, necessitating the selective use of expertise for the purpose of furthering government objectives. In this process, government often relegates counterexpertise, if not dismissing it outright, thereby greatly politicizing the policy (...) deliberation process. We argue that this manoeuvring by government spells trouble for both democratic deliberation on the issue of biometric identification in the UK and, more generally, expertise-based policy making in related technological ventures. Online data collection methods are expanding the ease and access of developmental research for researchers and participants alike. While its popularity among developmental scientists has soared during the COVID-19 pandemic, its potential goes beyond just a means for safe, socially distanced data collection. In particular, advances in video conferencing software has enabled researchers to engage in face-to-face interactions with participants from nearly any location at any time. Due to the novelty of these methods, however, many researchers still remain uncertain about (...) the differences in available approaches as well as the validity of online methods more broadly. In this article, we aim to address both issues with a focus on moderated data collected using video-conferencing software. First, we review existing approaches for designing and executing moderated online studies with young children. We also present concrete examples of studies that implemented choice and verbal measures and looking time across both in-person and online moderated data collection methods. Direct comparison of the two methods within each study as well as a meta-analysis of all studies suggest that the results from the two methods are comparable, providing empirical support for the validity of moderated online data collection. Finally, we discuss current limitations of online data collection and possible solutions, as well as its potential to increase the accessibility, diversity, and replicability of developmental science. How do we know right from wrong? Do we even have moral knowledge? Moral epistemology studies these and related questions about our understanding of virtue and vice. Drug Safety Communications are used by the Food and Drug Administration to inform health care providers, patients, caregivers, and the general public about safety issues related to FDA-approved drugs. To assess patient knowledge of the messaging contained in DSCs related to the sleep aids zolpidem and eszopiclone, we conducted a large, cross-sectional patient survey of 1,982 commercially insured patients selected by stratified random sampling from the Optum Research Database who had filled at least two prescriptions for either zolpidem or eszopiclone (...) between July 1, 2012 and June 30, 2013. Among the 594 respondents, two-thirds reported hearing generally about drug safety information prior to starting a new drug, with the remaining one-third “rarely” or “never” hearing such information. Providers and pharmacists were primary sources of drug safety information. Two-thirds of zolpidem users and half of eszopiclone users reported having heard about the related DSC messages, ability to accurately identify the major factual messages was limited. Respondents reacted to new drug safety information about their sleep aids by reporting that they would want to learn about alternative ways to help them sleep and seek out more information about the safety of their specific sleeping pill. Opportunities may exist for the FDA to work with providers and pharmacies to help ensure the DSC information is more widely received and is more fully understood by those taking the affected medications. We use Nietzsche’s On the Genealogy of Morality as a touchstone for comprehending Trump’s appeal and victory. Following Nietzsche’s concerns, the most noteworthy puzzle is that of Trump’s peculiar popularity, especially given his impolitic statements and policy proposals that often appear in tension with the interests of his voter base. While Nietzsche’s discussions of power and resentment would seem obvious starting points to examine the success of Trump and Trumpism, we contend that these provide largely superficial and, at best, incomplete (...) explanations. Instead, informed by Nietzsche’s moral psychology, we analyze Trump’s strategy in the context of the instinctual need for self-preservation. Trump’s amplification of this need through his rhetoric and cultivation of negative emotions, including resentment, has led to a revaluation that diminishes humanity. We conclude by drawing out the implications of Nietzsche’s view, revealing a forceful Nietzschean critique of Trump’s methods and values. (shrink)
